The Delisting Disaster
After February 20, 2012, Nintendo removed the game from the DSi Shop. Later, when the 3DS eShop launched, the game briefly returned for promotional periods (most notably in 2014 for A Link Between Worlds hype), but it was always a "limited time event."
Legality
While Nintendo no longer sells Four Swords Anniversary Edition, and you cannot buy it via the eShop, the copyright is still active. Nintendo’s official stance (as stated in their legal FAQ) is that downloading ROMs of any game, even delisted or "abandoned" titles, is copyright infringement.
The Confusion: DS vs. GBA
When searching for a "Four Swords DS ROM," there is often a confusion of terms.
